PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING OUR SITE OR MAKING A BOOKING. By accessing or using the Villa Finder website (the "Site") or making a reservation through us, you ("You", "Your", "Customer") agree to be bound by these Terms of Use ("Terms"). If You do not agree to these Terms, You must not use our Site or services.

1. Introduction & Definitions

  • Villa Finder ("We", "Us", "Our"): Villa Finder Pte. Ltd. (Registration No. 200718423H), a company incorporated in Singapore providing an online platform for booking vacation rental properties.
  • Owner: The third-party owner, leaseholder, or authorized manager of the Villa You are booking.
  • Villa: The vacation rental property listed on our Site that You book.
  • Site: Our website (villa-finder.com and related sites) and platform.
  • Booking: Your reservation request and confirmation for a specific Villa for specific dates.
  • Stay: The period during which You occupy the Villa according to Your Booking.
  • Total Rent: The total cost for renting the Villa for Your Stay, including base rate, service charges, and applicable taxes, as displayed during booking (excluding the Security Deposit).
  • Security Deposit: An amount collected to cover potential damages during Your Stay, as detailed in Clause 6.

2. Our Role as Intermediary

  • Platform Provider: Villa Finder operates the Site as an online platform allowing You to discover and book Villas directly from Owners.
  • Intermediary Only: We act solely as an intermediary between You and the Owner. We transmit Your booking details to the Owner and send You a confirmation email for and on behalf of the Owner.
  • Direct Contract with Owner: When You make a Booking and it is confirmed, You enter into a direct and legally binding contractual relationship with the Owner for Your Stay at the Villa. Villa Finder is not a party to this rental contract between You and the Owner.
  • Owner's Responsibility: The Owner is solely responsible for providing the Villa accommodation and any associated services as described in the listing and Your booking confirmation.

3. Information on the Site

  • The Curation Standard: Villa Finder is a curated collection. We are selective; we independently vet Villas at the point of onboarding and through periodic quality reviews to ensure they meet our standards for family and group travel.
  • Dynamic Nature of Properties: You acknowledge that vacation rentals, particularly in tropical climates, require constant daily maintenance and may undergo changes. Between our periodic inspections, Owners may update decor, change amenities, or experience maintenance issues (e.g., HVAC, plumbing, or pool equipment) without our prior knowledge.
  • Information Accuracy: Information on our Site is based on data provided by Owners and our most recent inspection. While we strive for accuracy, Villa Finder does not provide a 24/7 guarantee of the Villa's condition. We are not liable for:
    • Significant changes made by the Owner or issues that were not disclosed to us;
    • Sudden maintenance failures occurring just prior to or during Your stay;
    • Minor discrepancies between the Site’s photography and the current state of the Villa.
  • Our Role in Discrepancies: We are not liable for any errors, omissions, or misleading information provided by the Owner, unless caused by Our own negligence. We recommend You review all booking details carefully. Should you find the Villa does not substantially match the description provided at the time of booking, our role is to act as Your advocate. We will facilitate communication with the Owner to rectify the issue as per Clause 11, but the legal liability for the property's condition remains with the Owner.

4. Booking Process

  • Booking Request: By completing the booking process on our Site, You are making an offer to book the selected Villa under the terms displayed and these Terms of Use.
  • Your Information: You warrant that all information You provide during the booking process is accurate, complete, and current.
  • Confirmation: Your Booking is confirmed only when You receive a written booking confirmation email from Villa Finder sent on behalf of the Owner. This confirmation signifies the formation of Your direct contract with the Owner for the Stay.

5. Payments

  • 5.1. Payment Authorization: You authorize Villa Finder to collect payments, specifically the Deposit and Balance Payment for the Total Rent, on behalf of the Owner according to the payment schedule outlined during Your booking process and these Terms. The handling of the Security Deposit is detailed separately in Clause 6.
  • 5.2. Deposit Payment: To confirm Your Booking, You must pay a non-refundable deposit ("Deposit"). The required amount, typically a percentage of the Total Rent as specified during the booking process, must be paid upon booking.
  • 5.3. Balance Payment: The remaining balance of the Total Rent ("Balance") must be received by Villa Finder no later than the due date specified during the booking process and confirmed in Your booking confirmation (typically a set number of days prior to Your scheduled check-in date). Failure to pay the Balance by the due date constitutes a breach of these Terms and may result in the cancellation of Your Booking by the Owner, with forfeiture of Your Deposit.
  • 5.4. Pricing and Villa Default Currency: The fundamental price for Your Villa rental (Total Rent) is set in a specific currency determined by the Villa Owner ("Villa Default Currency"). This currency, along with the specific Deposit and Balance amounts calculated in this currency, will be clearly indicated during the booking process.
  • 5.5. Payment Currency, Exchange Rates, and Fluctuations:
    1. Payment Currency Option: For Your convenience, Villa Finder may offer You the option to make Your Deposit and Balance payments in certain other major currencies ("Payment Currency"), such as USD, AUD, EUR, SGD, HKD, NZD, GBP, as available on the Site at the time of payment.
    2. Exchange Rate Application: If You choose to pay in a Payment Currency different from the Villa Default Currency, the conversion will be based on the prevailing UOB FOREX public sell rate applicable on the date Your specific payment (whether Deposit or Balance) is successfully processed by Villa Finder.
    3. Acknowledgement of Rate Fluctuations: You acknowledge and agree that foreign exchange rates fluctuate constantly. The exchange rate applied when Your Deposit is processed may differ from the exchange rate applied when Your Balance payment is processed.
    4. Impact on Payment Amounts: Consequently, while the Deposit and Balance payments represent fixed amounts in the Villa Default Currency, the actual amounts charged to You in Your chosen Payment Currency may vary between the Deposit transaction and the Balance transaction due to these exchange rate fluctuations.
    5. Indicative Pricing: Any price displayed in a Payment Currency on the Site prior to You initiating the payment transaction is indicative only, based on exchange rates at that moment. The final amount charged in the Payment Currency will be determined solely by the exchange rate specified in sub-clause 5.5(b) at the time of payment processing.
    6. No Liability for Fluctuations: Villa Finder is not responsible or liable for any differences in the amounts charged in the Payment Currency arising from exchange rate fluctuations. The total amounts paid, when converted back to the Villa Default Currency using the rates applied by Us on the respective transaction dates, will correspond to the required Deposit and Balance amounts.
  • 5.6. Bank and Card Fees: You are solely responsible for any additional fees related to currency conversion or international transactions that may be charged by Your bank or payment card provider.

6. Security Deposit

  • Collection: We may collect a Security Deposit on behalf of the Owner prior to Your check-in, as specified for the Villa during booking. This may be via credit card pre-authorization or separate payment.
  • Purpose: The Security Deposit is held solely to cover costs of verifiable damage You or Your party cause to the Villa or its contents during Your Stay, beyond normal wear and tear. It does not cover normal cleaning or utility usage unless explicitly stated. For clarity, normal wear and tear excludes damages such as breakages, stains, spills requiring specialized cleaning, damage to furniture/fixtures, or any damage resulting from negligence or violation of House Rules.
  • Owner Claims: The Owner must notify Us in writing with documented proof (photos, invoices/estimates) of any damages within seven (7) calendar days of Your check-out to claim against the Security Deposit.
  • Refund: If no claim is received from the Owner within the 7-day period, We will release/refund the Security Deposit to You within approximately thirty (30) business days following the end of the claim period.
  • Disbursement: If a valid claim is received, We will release the documented amount (up to the deposit total) to the Owner and refund any remainder to You, also within approximately thirty (30) business days.
  • Disputes & Liability: Disputes regarding damages must be resolved directly between You and the Owner. The Security Deposit may not cover all damages; You remain liable to the Owner for any damages exceeding the Security Deposit amount. We are not liable for disputes regarding damages or the Owner's assessment thereof.

7. Cancellations and Modifications

  • Cancellation by You:
    • Your Booking is subject to the cancellation policy displayed at the time You make Your Booking and in Your confirmation email. Please review it carefully.
    • Unless otherwise specified in the policy, payments made (Deposit and Balance) are typically non-refundable.
    • Notwithstanding the specific Villa cancellation policy regarding the Total Rent, if You cancel Your booking, Villa Finder will refund the Facilitation Fee portion (our service fee included in the price You paid) collected by Us. Refunds of the rental portion depend entirely on the Owner's cancellation policy applicable to Your booking.
    • Any refunds processed to You arising from Your cancellation under this clause (7) may be subject to an administration fee of 200 USD (or its equivalent in Your Payment Currency based on the exchange rate at the time of processing). This fee, if applied, will be deducted from the total refund amount due to You.
  • Cancellation by Owner:
    • In the unlikely event the Owner cancels Your confirmed Booking, the Owner is obligated to provide a full refund of amounts You have paid for the Total Rent.
    • Villa Finder will facilitate the refund process from the Owner to You.
    • We will use reasonable efforts to assist You in finding comparable alternative accommodation or provide support as outlined in our procedures, potentially utilizing funds recoverable from the original Owner for relocation costs as per our agreement with them. However, our ability to secure alternatives depends on availability and the Owner's fulfillment of their obligations to Us.
    • No administration fee will be charged to You if the cancellation is initiated by the Owner.
  • Modifications Requested by You:
    • If You wish to request a modification to Your confirmed Booking (e.g., change of dates, change in number of guests subject to Villa capacity), please contact Villa Finder in writing as early as possible.
    • All modification requests are subject to the approval of the Villa Owner and property availability. Modifications may result in a change to the Total Rent (increase or decrease).
    • If the requested modification is approved by the Owner and confirmed, processing this change may be subject to an administration fee of 200 USD (or its equivalent in Your Payment Currency), payable by You in addition to any increase in the Total Rent.

8. Travel Insurance

Strong Recommendation: We strongly advise and recommend that You purchase comprehensive travel insurance prior to Your trip. This insurance should ideally cover trip cancellation/interruption, medical emergencies, loss/damage to baggage and personal belongings, and personal liability. This is crucial for unforeseen events affecting Your travel or stay.

9. Your Stay & Responsibilities

  • Check-in/Check-out: Adhere to the check-in and check-out times specified in Your booking confirmation unless otherwise agreed directly with the Owner or their representative.
  • House Rules: You agree to abide by the House Rules provided by the Owner for the Villa. These may cover aspects like noise levels, smoking policies, guest limits, pet policies, and use of facilities. Failure to comply may lead to deductions from Your Security Deposit or, in serious cases, eviction without refund. House Rules may also include specific guidelines related to waste disposal or resource conservation at the Villa.
  • Guest Conduct: You are responsible for the conduct of all members of Your party. You agree to occupy the Villa responsibly, respect the property, neighbors, local culture, laws, and customs. Be mindful of Your environmental impact by conserving water and energy and managing waste responsibly. Illegal activities are strictly prohibited.
  • Occupancy Limits: Do not exceed the maximum number of guests specified for the Villa without prior written approval from the Owner via Villa Finder.
  • Responsibility for Damages: You are responsible for leaving the Villa in a reasonably clean and tidy condition and are liable for any Damages caused by You or Your party during Your Stay. You agree to report any accidental damage to the Owner or their representative promptly. Costs for Damages exceeding the Security Deposit remain Your liability towards the Owner.
  • Personal Belongings: Your personal belongings are Your responsibility. Neither Villa Finder nor the Owner is liable for loss or damage to Your personal property unless caused by their negligence.

10. Responsible Tourism & Your Stay

Villa Finder is committed to promoting tourism that respects the environment and benefits local communities. We encourage You, as our Customer, to join us in this effort during Your Stay. While enjoying Your Villa and the destination, please consider the following:

  • Environmental Responsibility:
    • Conserve Resources: Be mindful of water and electricity consumption. Please turn off lights and air conditioning when leaving the Villa or when not needed.
    • Waste Management: Please dispose of waste responsibly. Utilize recycling bins provided at the Villa according to local guidelines, and minimize single-use plastics where possible. Many Owners provide filtered water dispensers as an alternative to bottled water.
    • Towel & Linen Reuse: Consider reusing towels and linens during Your stay to help conserve water and energy used in laundering (often Owners will have a specific policy for this).
  • Community Respect:
    • Local Customs & Noise: Please respect local customs, traditions, and neighbours. Be mindful of noise levels, especially during evenings and early mornings.
    • Support Local Economy: We encourage You to support the local economy by visiting local markets, dining at local restaurants, purchasing local crafts, and utilizing services offered by local providers. Villa Finder may provide recommendations for vetted local experiences.
  • Protecting Nature: Help preserve the natural beauty of the destination by avoiding activities that could harm local flora, fauna, or ecosystems. Follow guidelines when visiting natural parks or marine areas.

11. Issues During Your Stay

  • Contact Owner/Manager: If You encounter any issues with the Villa (e.g., maintenance, cleanliness, amenities not working), You must first contact the Owner or their designated local representative (contact details usually provided pre-arrival or at the Villa) as soon as the issue arises to allow them the opportunity to resolve it promptly.
  • Villa Finder Facilitation: If You are unable to reach the Owner/representative or the issue is not resolved satisfactorily within a reasonable time, please contact Villa Finder. We will act as a facilitator to aid communication with the Owner. We may provide You with the Owner's direct contact details if needed.
  • Resolution: While We will assist, the ultimate responsibility for resolving issues related to the Villa itself lies with the Owner. If the Owner fails to provide a reasonable solution for a significant issue affecting Your stay, We may intervene as per our agreement with the Owner, which could involve facilitating compensation or relocation where feasible. Please understand that while Villa Finder will make reasonable efforts to assist based on our agreement with the Owner, our ability to enforce solutions like compensation or relocation ultimately depends on the Owner's cooperation and adherence to their contractual obligations.

12. Specific Potential Issues

  • Construction/Noise: Villas may be located in areas where construction or other sources of noise are present. The Owner is obligated under our agreement to inform Us of significant disturbances within 300m. If We are informed prior to Your stay, We will notify You. Compensation or solutions in such cases are the Owner's responsibility. We are not liable for disturbances unknown to Us or arising unexpectedly.
  • Accuracy of Listing: While We strive for accuracy, please refer to Clause 3. We are not liable for minor discrepancies between the listing and the Villa, provided the Villa substantially meets the booked standard. Significant misrepresentation should be handled via the Issue Resolution process (Clause 11).

13. Limitation of Liability & Disclaimer

Guest safety is a priority. Please be assured that We require Villa Owners, under our contractual agreement with them, to maintain essential safety standards at their properties (such as functional smoke detectors and compliance with local pool safety regulations, where applicable) for Your well-being.

  • Villa Finder's Role: You acknowledge Villa Finder acts only as an intermediary platform. We are not liable for the actual provision of the Stay, the condition of the Villa, the actions or omissions of the Owner or their staff, security at the Villa, or any injury, loss, damage, death, inconvenience, or additional expenses You may incur arising from or related to Your Stay at the Villa, unless directly caused by Villa Finder's own gross negligence or wilful misconduct in providing its booking service.
  • Site Availability: We do not guarantee uninterrupted, error-free access to our Site.
  • Maximum Liability: To the maximum extent permitted by law, Villa Finder's total liability to You for any claim arising out of or related to Your use of our Site or booking service is limited to the amount of the Facilitation Fee We received for Your specific booking.

14. Privacy

Your use of our Site and services is subject to our Privacy Policy [Link to Privacy Policy], which explains how We collect, use, and protect Your personal data. By using our services, You consent to such processing.

15. Intellectual Property

All content on the Site is owned by or licensed to Villa Finder and protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any content without Our prior written consent.

16. General

  • Governing Law: These Terms and any dispute arising out of or related to Your use of Villa Finder's booking service (not the stay itself) shall be governed by and construed in accordance with the laws of Singapore.
  • Disputes with Owner: Disputes arising from Your Stay must be resolved directly with the Owner, potentially subject to the local laws and jurisdiction where the Villa is located.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Amendments: We reserve the right to modify these Terms at any time. We will post the revised Terms on the Site, and the changes will be effective upon posting or as otherwise stated. Your continued use of the Site or services after changes are posted constitutes Your acceptance of the modified Terms. Check this page periodically for updates.
  • Entire Agreement: These Terms, along with the details provided during Your booking process and Your booking confirmation, constitute the entire agreement between You and Villa Finder regarding the booking service.
